April R. Barnes 2008 vehicle flipped over on Delaware, in the City of Tonawanda.

April R. Barnes, 21, Niagara Road, Niagara Falls, was traveling Northbound on Delaware Street, Tonawanda, around 1:30 a.m. Saturday, Oct. 27, when she drove her vehicle off the road, struck a National Grid pole at the corner of Delaware and Roosevelt Streets and flipped her 2008 two-door Toyota vehicle.

Prior to the arrival of patrol, Barnes was assisted out of her vehicle by an onlooker, who was later identified as Samuel Dipalma, 46, Winwood Avenue, Town of Tonawanda.

Dipalma, who was also intoxicated, had Barnes get in his car and they left the scene together.

When law enforcement arrived on the scene, the vehicle Dipalma was driving was identified. He, and Barnes, were apprehended at 1:49 a.m.

Dipalma told police that he instructed Barnes to get out of her vehicle, because she needed to go to the hospital and she had to do so before the police arrived so that she would not receive a “WDI.”

Barnes was charges with DWI; operating a motor vehicle with a BAC or more than .08; leaving the scene of an accident; and unsafe lane change. Her BAC was .15.

Dipalma was charged with DWI (E Felony); refusal to take the roadside breath test; aggravated unlicensed operation (AUO) of a motor vehicle in the first degree (Felony); AUO in the third degree and driving without a license and two suspensions.

Dipalma was convicted of a DWI in 2009 from the Town of Tonawanda.
